MEDICAL / HEARING-HEALTH NOTICE. Amphea sells hearing aids. We do not provide audiology or medical services and do not diagnose, treat, or cure hearing loss or any other condition. Any hearing checks, questionnaires, or educational materials on our website are general information only and are not a substitute for advice from a qualified audiologist or medical practitioner. Please seek professional care for any hearing concern, including sudden changes in hearing, ear pain, discharge, or other symptoms.

1. About These Terms and Who You Are Contracting With

This website, www.amphea.com.au (the “Site”), and the sale of products through it, are operated by Amphea Pty Ltd (ABN 84 701 548 049 / ACN 701 548 049) (“Amphea”, “we”, “us”, or “our”).

These Terms and Conditions of Sale (the “Terms”) govern your access to the Site and your purchase of products from it. By accessing the Site, placing an order, or purchasing any product, you agree to be bound by these Terms and by the policies referenced in them (including our Shipping & Returns Policy, Warranty, Payment Policy, and Privacy Policy). If you do not agree, please do not use the Site or purchase from us.

Our Site is hosted on Shopify. Amphea hearing aids are imported and sponsored into Australia by our parent company, Dabee Corp Pty Ltd, and sold by Amphea under licence.

2. Eligibility

By placing an order, you confirm you are at least 18 years old and able to enter into a binding contract. You may not use our products for any unlawful purpose.

3. Products, Descriptions and Availability

We try to describe and show our products as accurately as possible, including colours and images, but cannot guarantee your device’s display is accurate. Products may be available in limited quantities and are subject to our Returns Policy. All descriptions and prices may change at any time without notice, and we may discontinue any product at any time.

4. Orders, Pricing and Acceptance

All prices are shown in Australian dollars (AUD) and are inclusive of GST where applicable. Your submission of an order is an offer to purchase. A contract is formed when we accept your order and confirm dispatch; we may decline or cancel any order at our discretion, including where a product is unavailable, where there is a pricing or description error, or where we suspect fraud or reselling.

You agree to provide current, complete, and accurate information so we can complete your orders and contact you. Occasionally the Site may contain typographical errors or inaccuracies relating to descriptions, pricing, promotions, or availability, and we reserve the right to correct them and to change information or cancel orders at any time, even after an order is submitted.

5. No Reselling

Products are sold for personal use only. Without our prior written consent, you may not resell, reproduce, or commercially exploit any Amphea product, and we may refuse or cancel orders we reasonably believe are placed by dealers or resellers.

6. Acceptable Use of the Site

You agree not to use the Site for any unlawful purpose, to infringe our or others’ intellectual property, to harass or abuse others, to submit false information, to upload malicious code, to collect others’ personal information, or to interfere with the security of the Site. We may terminate your use of the Site for any breach of these Terms.

7. Intellectual Property

The Site and its content — including text, graphics, logos, product names, and the “Amphea” brand — are owned by or licensed to us and protected by law. You may not copy, reproduce, or exploit any part of the Site without our prior written permission, other than as needed to browse and place an order.

8. Third-Party Links

The Site may link to third-party websites we do not control. We provide these without warranty and are not responsible for their content or practices. Your use of any third-party site is at your own risk and subject to that party’s terms.

9. Shipping, Returns and Warranty

Delivery, returns, refunds, our 60-Day Money-Back Guarantee, and product warranty are governed by our Shipping & Returns Policy and Warranty, which form part of these Terms.

10. Your Consumer Rights and Our Liability

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy you have under the Australian Consumer Law or other law that cannot lawfully be excluded.

To the extent permitted by law, and subject to those non-excludable rights, our liability for any product or the Site is limited (at our option) to replacing the product, supplying an equivalent, or refunding the price you paid.

11. Governing Law

These Terms are governed by the laws of New South Wales, Australia, and you and we submit to the non-exclusive jurisdiction of the courts of that State.

12. Changes to These Terms

We may update these Terms at any time by posting the updated version on this page. Your continued use of the Site or purchase of products after changes are posted constitutes acceptance of the updated Terms.

13. General

•      Severability — if any provision is unlawful or unenforceable, it will be limited or severed and the rest remain in effect.

•      Entire agreement — these Terms and the policies they incorporate are the entire agreement between you and us regarding the Site and your purchases.

•      No waiver — our failure to enforce any provision is not a waiver of it.
